Unleash Your Potential - CMCC Chiropractic Students

Four Canadian Memorial Chiropractic College students biked across Canada this summer raising awareness for health living for the Unleash Your Potential campaign. This was the 5th trip for the program that started in 2005 with a mission to promote the integration of physical activity, proper nutrition, and stress management into the daily lives of Canadians.

This boisterous quartet of Canadian chiropractic students accomplished their mission with school presentation and countless media appearances on radio, television and local papers across the country.  The riders( Brenna MacPhail, Matthew Missiha, Joe Sinopoli, and Kirsten Wishloff) cycled over 6,000 km from Alberta to Halifax, stopping almost every day to provide a lecture at a local school, summer camp or community group. Their inspirational educational events presented information to Canada's youth regarding healthy living, to encourage healthy habits at a young age, and in turn create a healthier generation for the future.

Unleash Your Potential did a great job chronicling their trip on facebook, blog,  and with this video:

Chiropractic Seminar on Vertigo

ChiroClasses.com has announced a new chiropractic seminar, Dealing with the Dizzy Patient, offering DCs the opportunity to receive advanced vertigo training. Dr. Joseph Ferezy author of The Chiropractic Neurological Examination textbook is offering this one day seminar on Saturday October 26th  2013 at Northwestern Health Sciences University in Bloomington Minnesota, certified for 10 hours of chiropractic continuing education.

Dizziness is one of the most common complaints to primary health care professionals.  The most common type of dizziness or true vertigo is Benign Paroxysmal Positional Vertigo (BPPV). This class will focus on some simple procedures to follow to diagnose BPPV from other causes of vertigo, including life threatening ones.

Chiropractors participating in this seminar will learn to diagnose and successfully treat BPPV in their offices. A treatment know as Canalith repositioning, or the Epley Maneuver, will be taught during the course and has been shown to be effective in over 90% of patients with BPPV is some studies. The training also includes use of the patented and FDA approved VertiGone goggles that dramatically increases the accuracy of performing the treatment and yields better results.

Dr. Ferezy course will demonstrate the importance of providing this service to your patients, as well as a new income stream for your Chiropractic practice. Diagnosis codes and CPT codes will be discussed and questions answered about billing procedures. After this event attending Chiropractic Physicians will be able to apply their new skills Monday morning and will receive a Vertigo Training Recognition Award.

The course runs from 8am-6pm and is accredited for Chiropractic CEs in: Iowa, Minnesota, North Dakota, South Dakota, and Wisconsin. Chiropractors Under Attack in SB 863

Last year the California Legislature passed Senate Bill (SB) 863  with the support of the governor and big business. The California Chiropractic Association lobbied heavily against the gut wrenching changes that limited chiropractors to 24 visits, disqualifying them after 24 visits as the treating physician, reducing reimbursements and restricting certification options. CE Cruncher covered the breaking news last year in: Changes Coming to Chiropractors in California's Work Comp.

Soon the California Division of Workers’ Compensation is holding a public hearing on the Predesignation of Personal Physicians and Reporting Duties of the Primary Treating Physician Rulemaking regulations. The meeting will take place on October 7 at 10:00am, in the auditorium of the San Francisco State Office Building at 455 Golden Gate Ave., San Francisco, CA 94102-3688.

Chiropractors will have the opportunity to discuss the new forms for employees that predesignate a physician in case of a work related injury. Doctors of Chiropractic will also be interested in the discussion about language to define “chiropractic visit” regardless whether an adjustment was preformed or not.

According to the California Division of Workers’ Compensation press release: Camera usage will be allowed in only one area of the hearing room. To provide everyone a chance to speak, public testimony will be limited to 10 minutes per speaker and should be specific to the proposed regulations. Testimony exceeding 10 minutes may be submitted in writing.

Can’t make it ? Chiropractors can submit written comment on the regulations until 5 p.m. October 7 2013. Comments can be faxed, emailed or mailed.

Written comments should be addressed or faxed to:

Maureen Gray, regulations coordinator
Department of Industrial Relations
Division of Workers' Compensation

Bachelorette Gets Adjusted By a Chiropractor

Six Millions of viewers last night watched Bachelorette Desiree Hartsock on her hometown visit with Chris Siegfried have an adjustment from his Dad, Chiropractor Dr. George Siegfried. Not only did he provide a thoracic adjustment and cervical rotary break, he also preformed the nasal specific technique on his son with a disturbing nostril close up.

Not familiar with the reality show the Bachelorette? A brief synopsis: An attractive 20 something woman is jet-setted around the world on dates with a dozen men with the expectation of a proposal at the end of the season. Each episode she eliminates one or more with a symbolic rose ceremony. The episode being discussed is referred to as the hometown visits which has occurred for the past 13 seasons when the field in narrowed to 4 potential suitors. Visits are planned for the bachelorette to meet with the prospective families. They usually include dinner with immediate family, a one on one discussion with a parent and a quirky interaction.

The quirky interaction for contestant Chris Siegfried’s trip home to Middleville Oregon occurred in his Dad’s basement Chiropractic office. Dr. Siegfried at the dinner table with a glass of wine in his hand offered to treat Bachelorette Desiree after a story about falling off of a rock during a previous adventure on the show. Down the stairs into the first floor walk-out office with walls lined with Meric and trigger point charts the Chiropractic father is shown diversified adjusting the tentative bachelorette.

A following scene shows Dr. Zeigler, a 1981 Western States Chiropractic College graduate, preforming the nasal specific technique by inserting a finger cot, affixed to a sphygmomanometer bulb into the nostrils of his son. The resulting camera close up after the inflated balloon was removed with mucus attached left this Chiropractor horrified and I imagine along with million of other viewers.

Primetime television with a live audience of millions and more onlie is the exposure that chiropractors everywhere dream of, but is this message what we want presented to the general public? We all know one Chiropractor does not represent the entire profession, but last night Dr. George Siegfried did. Unfortunately without exams, histories and orthopedic tests the Chiropractor appeared to be conducting well timed parlor tricks. We will never know what was cut on the editing floor, except it was less entertaining than the Former Vice President of the Oregon Board of Chiropractic Examiners Dr. Siegfried’s supine cervical and p-a thoracic adjustments with grossly exaggerated noises.

The conversation about Chiropractic on the Bachelorette has already begun, Tweets appear throughout the live show.

MediCal Decision in Favor of Chiropractic

According to a the Ninth U.S. Circuit Court of Appeals decision California State lawmakers improperly stopped Medi-Cal’s funding of Chiropractic treatment and other medical services for the rural poor and other underserved areas. During the 2009 budget crisis in California the legislature allowed the Department of Health Care Services to discontinue funding of services provided by Chiropractors, Dentists, Optometrist, Podiatrists and Speech Therapists at “federally qualified health centers”. Medical Care coverage was not impacted.

The State of California contended that covering Chiropractic and the other specialties were not mandatory under the federal Medicaid Act. The three-judge panel of the 9th U.S. Circuit Court of Appeals disagreed.

California’s Mediacaid program California Medical Assistance Program or Medi-Cal is jointly administered by the California Department of Health Care Services (DHCS) and the Federal Government’s Centers for Medicare and Medicaid Services. It provides health coverage for low income people.

A spokesperson for the California Department of Health Care Services (DHCS) sent an email stating "DHCS is examining this ruling and considering its potential next steps."

The state has four options: seek reconsideration by the appeals panel, a hearing before an enlarged panel of the 9th Circuit, or a review by the U.S. Supreme Court, or it can live with Friday's opinion.

Bought the Movie - from the Creators of Doctored

Doctored made a huge impact on the Chiropractic profession last year. Numerous Chiropractic Colleges, Chiropractic State Associations and individual Chiropractors offered screenings of the movie to help promote the message of undue influence of the pharmaceutical industry, the AMA and the corruption in the medical model. It is difficult to find a Chiropractor that was not directly impacted by this movie.

Now the producer of Doctored, Jeff Hayes, has a new movie titled Bought. This amazing documentary offers a look in to the corruption of society by GMO producers, pharmaceutical companies and the vaccine industry. These multinational corporations are negatively impacting the health and well-being of the world with high priced ad campaigns and paying for governmental influence.

Bought exposes the problems in the vaccine court, the untold stories of the victims of vaccines, along with interviews from Chiropractor Patrick Gentempo & medical researcher and surgeon Andrew Wakefield. The billions of dollars drug companies and medical device manufactures pay for advertising, financial incentives to physicians and the resulting interests hidden from the public are addressed. This movie covers the Monsanto Protection Act that rallied many Chiropractors and concerned citizens to stand up to the government’s blatant disregard to the impact of GMOs on public health and safety.

Bought is almost completed and you can help. Jeff Hays films created an opportunity for Chiropractors to support the movie in exchange for early release DVDs, signed books, tickets to the world premier and even the opportunity to create your own viewing event to market your Chiropractic practice.  Contribute to Bought

Bought teamed up with Indiegogo, a well respected crowdfunding platform. Not familiar with crowdfunding? Let us explain. Crowdfunding is an old concept redeveloped for the digital age. It offers an opportunity for many people to invest online for varying amounts to help fund a project. Bought the Movies's campaign strives to help cover the production and distribution costs of the movie in exchange for early release copies of the movie and screening events. The opportunity ends Wednesday July 10th at midnight, so sign up to pledge right now and tell your friends.

Chiropractors for generations have strived to convey the message of health living and wellness, but also educating the public about vaccines, pharmaceuticals and more recently GMOs. Bought offers an opportunity for this message to reach millions in a well researched, concise documentary.

Watch the Trailer of Bought.

Latest Attack Against Texas Chiropractors is Over

The legal battle waged by the Texas Medical Association against Doctors of Chiropractic in Texas was stopped by the Texas Supreme Court. On June 14th 2013 the Texas Supreme Court denied the petition of the Texas Medical Association for additional review of their lawsuit against the Texas Chiropractic Association and the Texas Board of Chiropractic Examiners over Chiropractors' legal ability to diagnosis.

This latest court decision allows the previous Austin Court of Appeals ruling to stand, keeping the Texas Board of Chiropractic Examiners rule in place that allows Chiropractors to: uses objective or subjective means to analyze, examine, or evaluate the biomechanical condition of the spine and musculoskeletal system of the human body (Sec.201.002.B(1)).

The Texas Medical Association has attacked Chiropractors in Texas before. The TMA eliminated Needle EMG and Manipulation under Anesthesia from the Chiropractic scope of practice with the same lawsuit 2 years ago. The TMA’s recent comments should leave the almost 5,000 Chiropractors in Texas preparing for another fight.

The Nevada Chiropractic Association Supported the Bill

Chiropractic assistants still need to be supervised in Nevada. Nevada’s Governor Brian Sandoval vetoed Senate Bill 198 this week, it would have allowed Chiropractic assistants to work under indirect supervision. They could provide services if the Chiropractor was out of the office, but accessible by phone or electronic means.

Sen. Joe Hardy, MD sponsored the bill that received no opposing votes in the Nevada House or the Senate. The bill also had the support of the Nevada Chiropractic Association .Dr. James Overland, president of the Nevada Chiropractic Association, stated in a letter to the Senate Committee on Commerce, Safety and Labor, “We have all had the unpleasant experience of patient’s waiting too long or leaving the office because the chiropractor could not be present due to unforeseen circumstances. In this case the patient receives no therapy as well as incurring an unfortunate expense for travel time. The Chiropractor is also denied the income the patient would have generated.”

Opposition to the Bill 198 initially came from two current and two past members of the Nevada Chiropractic Physicians Board over patient safety. After amendments to the bill allowing the Chiropractic Board to define the regulations for Chiropractic assistants the Nevada Chiropractic Physicians Board  voted to take a neutral position on the bill.

The law governing Nevada Chiropractic Assistants stands as:
NRS 634.123  Chiropractor’s assistant: Qualification; certification; supervision.
1.  The Board may issue a certificate to a properly qualified applicant to perform ancillary services relating to chiropractic, other than chiropractic adjustment, under the supervision of a chiropractor. The Board shall specify the formal training, including at least 12 months of study or the equivalent, which such an applicant must have completed before the Board awards the applicant a certificate as a chiropractor’s assistant.

ASHN Representing Chiropractic on the Hill

American Specialty Health’s (ASH) Vice President of Public Affairs R. Lloyd Friesen, DC took part in meetings with 3 senators last week promoting chiropractic. Under the Umbrella of The National Association of Specialty Health Organizations (NASHO) Dr. Friesen along with representatives from other Chiropractic health specialty organizations were lobbying a white paper promoting the inclusion of Chiropractic care and Chiropractic management organization in the Affordable Care Act around DC. Other participants included the executives from ChiroCare of Minnesota, Palladian Health and the CHP Group.

The National Association of Specialty Health Organizations (NASHO) serves as a national organization and lobbyist for numerous health specialty companies. Health specialty organizations or Chiropractic Networks are more commonly known to Chiropractors as the companies that contract with major insurance providers to manage Chiropractic benefits. They make money by cutting reimbursements and visits for Chiropractic care from contracted insurance plans.

The white paper that NASHO’s Chiropractic Council created highlights the benefits of Chiropractic care, the high satisfaction rate, the cost reduction compared to medical treatment as it pertains to low back pain and a VA study on Chiropractic and neck pain. The white paper also suggests primary care co-pays rather than specialty rates, Chiropractors as point of entry, and inclusion in the medical home for musculoskeletal care.

A few claims in NASHO’s White Paper that may not be well received by Chiropractors currently battling with a health specialty organization over payments. The paper states the benefits of health specialty organizations or Chiropractic networks (as they call themselves) include “gain preferred access to patients covered by plans and insurers, adding volume to the chiropractic practice.” They suggest that the Chiropractic networks also offer Chiropractic Continuing Education in care management and best practices. Various times in the paper they refer to cost-effective rates, medical necessity and no over utilization. This translates into practice as lower reimbursement than the terms of the plan, lower ceilings on visits and billable procedures and arbitrary cut offs of treatment.

Throughout the paper the American Chiropractic Association is referenced, amusing considering that ACA announced a class action suit last year against American Specialty Health Networks’ practices against Doctors of Chiropractic participating in CIGNA insurance plans across the county. The quality of representation of the Chiropractic profession by this lobby organization and Chiropractic networks should be questioned when other references in the paper include WebMD and NASHO’s own website.

What is you experiece with ASHN and other Specialty Health Organizations? Any tips for other Chiropractors?

Langford Chiropractic’s Controversial Sign

Many states have law and rules on how Chiropractors can advertise their businesses, but taste does not seem to be regulated. Two recent chiropractic ads have generated a buzz on the internet. Both gathered attention and press, will it advanced their practices…. only time will tell.

CE Cruncher is not endorsing either of these ads, but merely trying to start a conversation about the impact of advertising on the Chiropractic Practice and the profession as a whole.

Let us know what you think by posting your thought in the comments.

A Slave to Back Pain

Last week a 75 year old Broken Arrow Oklahoma Chiropractor posted on the sign outside of his office “You are a chained slave to a broken back, Get help here!”. The Chiropractor, Dr. Royal Langford of Langford Chiropractic explained in an interview to the local Fox affiliate that he was rephrasing a quote from his mentor the legendary Dr. Parker.

Photo Credit - Ken Tirpak (Thanks Dad)

Dr. Langford went on to explain that “Dr. Parker would always say ‘You are a chained slave to anyone you dislike, and I decided that would make a good reader board,” and followed up with “Apparently, it got somebody’s attention. It’s not meant to be anything negative.”

For years Dr. Langford changed his lettered sign in front of his office that is visible to passing vehicles multiple times a week for over 20 years. Attempting to attract attention and potential new patients. After the controversy he changed the sign to read “ Let me show you what your body can do, It’s my job!" The new slogan is less inflammatory, but for the public that is not familiar with Chiropractic it  may be a little provacative.

Cracked Chiropractic Commercial

A viral sensation with almost 3 million views in 3 days Dr. Ryan Lee’s Cracked Chiropractor commercial has generated much attention. The Los Angeles Chiropractor called on the internet video geniuses Rhett & Link, well know for the whimsical commercials and funny internet videos, to produce a commercial for his Chiropractic office.

Numerous websites have featured the amusing video in the last few days, including the Huffington Post. After reviewing most of the comments on the varying sites, the opinions of the public are mixed with an occasional battle of the efficacy of Chiropractic.

The Ryan Lee Chiropractic Center commercial’s melody and corresponding visual in the satirical video professes “Gentle, Comfortable, Professional”. Professional is probably not the sentiment that the video instills, but 3 million views is something only the Foundation for Chiropractic Progress could afford. Should we be grateful as Chiropractors for the exposure or concerned about the over dramatization of the practice of Chiropractic?

Share you thoughts.

Macquarie University Eliminating Chiropractic

Macquarie University in Sydney Australia wants to transfer their Chiropractic degree programs to another university by 2015, stating they are moving towards more "research-intensive" programs. Currently the Macquarie University has over 600 students enrolled in the Bachelor of Chiropractic Science and the Chiropractic Masters programs.

Currently four universities in Australia offer degrees in Chiropractic: Macquarie, Murdoch, RMIT and Central Queensland University.

On April 24th 2013 in a press release from the Macquarie University Clive Baldock, the newly-appointed Executive Dean of Science Professor stated “… our Chiropractic area does not meet our requirements from a research-intensive perspective…”

Professor Baldock goes on to discuss wanting to focus research and teaching towards the University’s recently expanded medical school and hospital.

The Chiropractic Association of Australia (CAA) started to organize a student protest on the campus of Macquarie University over the elimination of the Chiropractic degree programs, but put a halt to it after the University promised all Chiropractic students would be allowed to finish their current degree. Last week Andrew McNamara the CAA National CEO met with Professor Bruce Dowton, the Macquarie University Vice Chancellor, to appeal for a smooth transition of both the students and staff to another institution.

On Facebook, The CAA called on Chiropractors and Chiropractic students to “Get out and amongst it. Let the University know that you’re not going to accept this!!! Use your voice! Keep Chiropractic on campus!!”

A Chiropractor heard this “call to arms” and the Community Facebook page, “Help Save the Chiropractic Degree at Macquarie University” launched last Friday and already has over 600 likes. The page is the brainchild of Macquarie University 2000 Chiropractic graduate, Fleur Castlereagh of Kirrawee Family Medical Practice. She started the page to increase awareness of Macquarie University’s decision to transfer the Chiropractic Degree program, highlight successful graduates and hopefully reverse her alma mater’s decision.

A backlash against Chiropractic has been brewing in Australia for years, fueled heavily by the Friends of Science in Medicine. According to a co-founder Professor John Dwyer of the University of New South Wales "We met with the university and suggested that a major tertiary institution should not offer these courses."

The Friends of Science in Medicine, sponsored by the Australia Skeptics, are attempting to remove CAM (Complementary and Alternative Medicine) from Universities and public health programs in Australia. The group unsuccessfully attempted to block the creation of a Chiropractic Program at Central Queensland University in 2011.

Chiropractic started at Macquarie University with the acquisition of the independent 40-year-old institution Sydney College of Chiropractic. The Chiropractic College’s courses, resources and staff converted to the Center for Chiropractic offering a Chiropractic Masters program with in the School of Biological Science at Macquarie University in 1990. The University currently offers 2 education paths: a Bachelor of Chiropractic Science followed by a Master of Chiropractic Degree in 5 years and a Graduate Diploma in Chiropractic or the Graduate Certificate in Chiropractic Science preceded by a Bachelor in Health, Medicine, or Exercise Science requiring 6 to 7 years.

Chiropractors’ Role in TN Workers’ Comp Expanded

Chiropractors in Tennessee can now be part of all of the workers' compensation physician panels offered to injured workers, not just the ones with back pain. Currently Tennessee law dictates that employers are required to provide injured employees with a panel of three physicians or surgeons from which the employee may select the treating physician for their work related injuries. For back injuries the panels included a fourth position reserved for a Chiropractor.

The new Tennessee workers’ compensation law requires the employer to provide three or more independent reputable physicians, surgeons, Chiropractors or specialty practice groups for all cases, not just back injuries. Chiropractors in Tennessee have an opportunity to inform the public along with local businesses about the benefits of Chiropractic treatment, cost effectiveness and that Chiropractors treat much more than back pain.

Chiropractors in Tennessee can take advantage of the new law and inform local businesses owners of the advantages and cost effectiveness of Chiropractic treatment.

  • Ask patients about work comp decision makers at their companies to contact
  • Put together a packet of information about your office, include research, flyers and business cards
  • Talk to business owners over lunch and offer to provide safety workshops for employees
  • Add Workers Comp terms to your SEO strategy

Tennessee’s workers’ compensation bill passed the state house and senate last week, signed by the Governor Monday, and the majority of the law goes into effect July 1, 2014.

TMJ Chiropractic Seminar Tampa FL

Forty Chiropractors expanded their knowledge at the TMJ and the Cervical Spine Seminar with Dr. Mitch Mally on April 13th 2013. The Chiropractic Continuing Education course in Tampa Florida discussed TMJ anatomy, common dysfunctions, and the correlation with the cervical spine. After 4 hours of lecture including X-rays, MRI and DMX imaging of the temporomandibular joint Dr. Mitch Mally demonstrated his style of adjusting with bombastic flare. Dr. Mitch Mally is a well-known Chiropractor, holding extremity seminars all over the US and Europe. His approach is by no means subtle, calling on his martial arts experience with speed and precision.

Chiropractors traveled from Illinois, Pennsylvania, and both coasts of Florida to fill the seats of the seminar. One Chiropractor was overheard saying, “Dr. Mally really knows how to captivate an audience with his dramatic adjusting style.”

When asked about the highlights of the seminar numerous chiropractors mentioned their new confidence in analyzing and adjusting TMJ conditions. Many liked the ideas on how to market their newly learned skills in their Chiropractic Practice to Dentists and Medical Doctors. Over half of the participants had attended a Chiropractic Continuing Education Seminar with Dr. Mally before and remarked that if the opportunity arose they would do it again.

CE Cruncher offered online registration for the seminar along with coffee, tea and Cuban pastries for the participating Chiropractic Physicians.

Personal Injury Chiropractor Mark Cereceda Pleaded Guilty

The owner of 6 Personal Injury Clinics in South Florida, Dr. Mark Cereceda, pleaded guilty to three misdemeanors of making a campaign contribution in the name of another. Dr. Mark Cereceda had over 30 of his employees working at his Chiropractic Clinics to contribute $500 (the maximum contribution in Florida) to various state wide political campaigns, and then he would then reimburse their contributions. His original charges when arrested included one felony and one misdemeanor relating to his illegal political contributions.

Dr. Cereceda’s sentencing included: over $100,000 in fines, $40,00 each to two different charities, three years of probation, 60 days house arrest. After his arrest on Feb 22 2013 he served 3 days in jail. Dr. Cereceda brother Kemel pleaded guilty to a felony count of making an excessive contribution in the name of another and received a similar sentence. The terms of their plea agreement also forbid them from making campaign contributions during their probation.

Court records detailed that his sentence contained a withhold of adjudication. This allows for the conviction to be voided after the terms of the probation are met, and legally state that they have not been convicted of a crime.

The fate of Dr. Cerecdas professional career has not been determined. According to the Florida Department of Health’s practioner profile records Dr. Cereceda Chiropractic license in active and in good standing. Currently The Florida Board of Chiropractic Medicine has not made any public reprimand. Chiropractors in Florida have 30 days to reports any conviction or if found guilty of a crime, regardless of adjudication, according to Florida State Statute 456.072(1)(x), F.S.

Police first started looking into Dr. Mark Cereceda contributions after a Miami Dade County Judge Ana Maria Pando had his corporation Florida Wellness & Rehabilitation Center restored by State of Florida using her official judicial letterhead. Dr. Cerecda had numerous Personal injury cases in front of the judge and contributed to her reelection campaign.

Dr. Mark Cereceda's Florida Wellness & Rehab Centers are part of the  1-800 411-Pain medical and lawyer referral services. Commonly known as 411 Pain in Florida, the service blasts commericals on TV, radio and billboard across the state advertising to victims of car accidents.

Chiropractic at UMass?

Know any faculty, students or staff at UMass? Tell them the Health Services Department needs a Chiropractor. The University of Massachusetts Health Services’ mission statement is receiving a makeover. To facilitate this the university this week is asking faculty, students and staff their opinions on current services and potential new services.

The vice chancellor for administration and finance, James Sheehan, wrote in an email to the UMass community “This survey will allow us to assess our current services, use of UHS by undergraduates, graduate students, faculty and staff, and interest in services that are not available at this time”.

Umass currently offers: general health, pediatric care, night and weekend walk-in hours, a pharmacy, radiology, physical therapy, mental health, sports medicine, acupuncture and eye care. They are considering adding: Chiropractic, a dental clinic and a separate women’s health clinic.

UMass Boston’s Center for Survey Research is conducting the survey. The survey’s questions cover the various services currently and potentially offered by UHS in order of importance to themselves and others at UMass. After the information is gather the results will be analyzed by an advisory board, then submitted the University Health Services Director’s team.

Tell all of your family, friends and patients the value of Chiropractic especially if they are enrolled or employed by UMass.

Chiropractic PIP Battle in Florida

Thursday March 21nd the Florida Insurance Commissioner office filed and was granted an appeal to stop a temporary injunction by a Florida State Appeals Judge in the ongoing recent Florida Personal Injury bill that went into effect Jan 1, 2013. The temporary injunction against the portion of the bill discrimination against providers issued by a Leon County judge Terry P. Lewis days earlier no longer stands.

The lawsuit over the PIP Bill was filed by attorneys Luke Lirot and Adam Levine on behalf of massage therapists and acupuncturists that were eliminated from the Florida No Fault Insurance and chiropractors that ad reimbursement severely limitied for treating car accident victims.

Currently the law is still in place, but late Thursday evening the attorneys Lirot and Levine filed an emergency motion to vacate the stay. They expect the motion will be on the Judge's desk by Monday.

The United Practitioners Organization Inc and the attorneys representing them in the case are asking for donations and affidavits on the impact of the new PIP law on your Chiropractic practice.

FL PIP Law Injuction, Chiropractors, Massage Therapists & Acupuncturists

Leon County Circuit Judge Terry P. Lewis granted an injunction on the portion of the Florida Personal Injury Protection Bill that limited coverage to Chiropractors, Acupuncturists and Massage Therapists.  The judge’s order puts a hold on the non-emergency benefits portion of the bill that limits treatment reimbursement of auto accident victims to $2,500, and excludes benefits for Massage and Acupuncture. His ruling was based on his opinion that 2012 PIP Bill (HB 119) violated the right of access to the courts found in the Florida Constitution.

Attorneys Luke Lirot and Adam S. Levine, MD JD filed a lawsuit for United Practitioners Organization Inc. on behalf of a group of Acupuncturists, Massage Therapists and Chiropractors against the Florida Office of Insurance Regulation. United Practitioners Organization Inc. funded the lawsuit through donations to their website since the PIP bill HB 119 passed last year. The group filed two prior suits over the discriminatory bill, both were dismissed.

Prior to the Florida no fault 2012 PIP bill changes, heavily lobbied by the Insurance industry and Governor Rick Scott, Personal Injury Protection benefits in Florida include $10,000 of medical coverage for car accident victims on their own car insurance policies. After the closed door, final hour legislative dealings benefits were reduced to $2,500 unless an emergency medical condition was declared by a MD, DO, DDS, PA or ARNP within 14 days of an auto accident. Coverage of Massage Therapy and Acupuncture was completely excluded.

So what does this Mean for Chiropractors, Acupuncturists and LMT's?

As long as the temporary injunction is in place, auto insurance companies are required to pay up to $10,000 for non-emergency conditions resulting from motor vehicle accidents, including Acupuncture and Massage Therapy. Unfortunately, a spokesperson for Florida’s Office of Insurance Regulation stated the office plans to file an appeal by Friday. An appeal could act as a hold on Judge Lewis’ court order. The appeal could be filed in First District Court of Appeal or directly to the Florida Supreme Court. Many questions have been raised and more answers should be available soon. Check back on CE Cruncher for more news about the impact of Florida PIP laws on Chiropractors as soon as it arises.
